Terms of Service

These terms govern your use of the Fifty Shades of Banana Bread Bakery website. By browsing, placing an order, or creating an account, you agree to the terms below.

1. About the bakery

Fifty Shades of Banana Bread Bakery is a small, in-home bakery based in Franklin, Kentucky. Orders are baked to order and available for in-person pickup only. We may adjust availability, timing, or order details based on inventory, production needs, or business conditions.

2. Orders and pickup

When you place an order through this site, you are making a request to purchase baked goods from the bakery. We reserve the right to refuse or cancel any order for any reason, including if the order appears suspicious, incomplete, or inconsistent with our pickup-only model.

3. Kentucky home-based processor

The bakery operates as a home-based processor under Kentucky law (KRS 217.136), registered with the Kentucky Department for Public Health. A kitchen registered this way is not subject to the routine inspection a commercial facility receives — it is inspected in response to a complaint or a foodborne-illness investigation. Shelf-stable baked goods such as banana bread are among the products that registration covers.

That status is also the reason we are pickup only. A home-based processor may sell only directly to the person who will eat the food, which for us means pickup arranged here in Franklin. We cannot ship or mail orders, and we cannot sell wholesale to shops or restaurants. Kentucky sets out what a home-based processor's label must carry, including the notice "This product is home-produced and processed." If you need the ingredients, net weight, or bake date for a particular loaf before you order, email Renee and she will give them to you directly.

4. Allergens and food safety

Every loaf is baked by hand in a private home kitchen in Franklin, Kentucky that is not subject to routine health department inspection, as described in the section above. That kitchen regularly handles wheat and gluten, eggs, milk and butter, peanuts, tree nuts, and soy, and the same bowls, pans, utensils, and oven are used across the whole lineup. Because of that shared equipment, we cannot guarantee that any item is free from any allergen, no matter which loaf you order.

Filter tags such as "Nut-Free" describe the ingredients a recipe is made with. They are not a promise about the kitchen it was baked in, and they do not mean the loaf was produced in a nut-free environment. Ingredients and supplier formulations can also change without notice. If you or the person you are buying for has a severe allergy or intolerance, please do not rely on these tags — contact Renee before you order and she will tell you honestly whether she can accommodate it. You are responsible for checking that a product is suitable before eating it or serving it to someone else.

5. Payments and card processing

Card payments on this site are processed by Square, Inc. We never see, handle, or store your card number — Square's own payment fields collect it directly, and all we receive back is a confirmation, the card brand, and the last four digits for your receipt. Paying this way means your payment is also subject to Square's own terms and privacy policy. Apple Pay, Google Pay, and Cash App Pay all run through that same Square connection.

Afterpay is a separate agreement between you and Afterpay, not with the bakery. If you choose to pay over time, Afterpay decides whether to approve you, sets your repayment schedule, and handles collection; any missed payments or fees are between you and them. We are paid once, up front, and cannot change, pause, or waive an Afterpay plan on your behalf.

All prices are in U.S. dollars. Your card is charged in full when you place the order — we do not place holds or pre-authorizations. Prices, tax, discounts, and availability are all recalculated on our own server at checkout, so the amount charged is the amount you were shown. If a genuine pricing error means you were charged the wrong amount, we will correct it and refund the difference rather than hold you to the mistake. If a charge looks wrong to you, email Renee before opening a dispute with your bank — it is almost always the faster way to fix it.

6. Cancellations and refunds

You can cancel your own order from your account for as long as it is still marked "Ordered" — the window before Renee confirms it. Once she has confirmed an order it is on her baking schedule and may already have been shopped for, so cancelling after that point is at her discretion: reply to your confirmation email and she will do what she can. Renee may also cancel an order herself at any time, and will always tell you why.

When an order is cancelled, anything you already paid online is returned automatically and in full. Card payments — including Apple Pay, Google Pay, Cash App Pay, and Afterpay — go back to the original payment method through Square. Gift card credit is returned to the gift card balance, so it is spendable again. If you used a promo code, the redemption is released so the code is not consumed by an order that never happened. We do not offer partial refunds through the site; a cancellation always returns the whole amount paid.

Refunds are issued the moment the order is cancelled, but how quickly the money appears is up to your bank or card issuer — usually a few business days. Orders paid in cash at pickup have nothing to refund, since nothing was collected. If a refund has not reached you within a week, email Renee and she will chase it down.

7. Gift cards

Gift card codes are issued by the bakery and come with a four-digit PIN. Both are needed to redeem one, so treat the pair like cash and share it only with the person you bought it for. A card's balance is drawn down as you spend it and can be used across as many orders as it takes to empty — there is no minimum and no obligation to spend it all at once. Gift cards do not expire.

Cards are redeemable only on this site, against pickup orders, and one card may be applied per order. They are not redeemable for cash and we do not give change: if a card is worth more than your order comes to, the difference stays on the card for next time. If an order paid with a gift card is cancelled, the credit returns to that same card rather than being paid out. If you lose a code, or think someone else has spent it, email Renee — she can look the card up and see its full history.

8. Promo codes

A promo code is a discount the bakery chooses to offer rather than something attached to your account, and we may change, pause, or withdraw one at any time. Individual codes can carry their own conditions — a minimum order value, a start and end date, or a cap on how many times the code can be used in total. Checkout will tell you which condition a code has failed if it will not apply.

One promo code may be applied per order. The discount comes off your subtotal, and a gift card is then applied to whatever is left to pay. Promo codes have no cash value, cannot be exchanged for a gift card, and cannot be added to an order after it has been placed. If you cancel an order that used a code, the redemption is released so the code is not spent on an order that never happened.

9. Crumbs rewards

Crumbs are a loyalty perk the bakery offers, not something you buy. You earn them only when one of your orders is completed — never when it is placed — at a rate the bakery sets and may change or pause at any time. Crumbs are tied to your account, have no cash value, are not property, and cannot be bought, sold, transferred to another account, or pooled with anyone else's. If a completed order is later cancelled, the Crumbs it earned are taken back.

To spend Crumbs, you redeem a reward from the rewards menu on your account. Each reward costs a set number of Crumbs and gives a discount — a percentage or a dollar amount off — as a single-use code you enter at checkout, where it behaves like a promo code and follows the promo rules above. Rewards have no cash value and we do not give change. We may change the rewards on offer, correct a balance we believe was earned or applied in error, and change or end the Crumbs program at any time; if we do, an unused balance is not redeemable for cash and no payout is owed. 10. Account use

You are responsible for keeping your account information accurate and secure. You may not use the site for unlawful, abusive, or deceptive purposes.

11. Intellectual property

All content on this site, including product descriptions, photography, branding, and design, is owned by Fifty Shades of Banana Bread Bakery unless otherwise noted. You may not reproduce it without permission.

12. Limitation of liability

To the extent permitted by law, the bakery is not liable for incidental, consequential, or special damages arising from your use of this site, including loss of profits, loss of data, or interruption of business.

The site and its contents are provided as they are. We do not promise the storefront will always be available, that everything shown will be in stock, or that descriptions, photographs, and flavor notes are free of error. Some product images are generated rather than photographed; treat those as an illustration of the loaf, not a picture of the specific one you will be handed.

Nothing in these terms limits liability that cannot be limited by law — including liability for death or personal injury caused by our negligence, or for fraud or fraudulent misrepresentation. Where liability can be limited, our total liability to you in connection with an order is capped at the greater of $100 or the amount you paid for that order. The floor is deliberate: a limit set at the price of a loaf would leave you with no remedy worth having. This cap does not apply to money we owe you back — a refund for a cancelled order is always the full amount paid, as set out in the cancellations and refunds section. And please read the allergen section closely: if you have a food allergy, the decision about whether a product is safe for you rests with you, and we would rather you spoke to Renee first.

13. Governing law

These terms, and any dispute arising out of them or out of an order placed through this site, are governed by the laws of the Commonwealth of Kentucky, without regard to its conflict-of-laws rules.

The bakery bakes, sells, and hands over every order in Franklin, so Simpson County is where the business and its records sit. Claims may be brought in the state or federal courts serving Simpson County, Kentucky, and we both agree those courts have jurisdiction. That is not meant to close off your nearest option: you are always free to bring a claim in small claims court where you live, and nothing here requires you to travel to pursue one. Nothing in this section affects consumer rights you hold under Kentucky law that cannot be waived by agreement.

If any part of these terms turns out to be unenforceable, the rest stays in force. If we do not enforce a term straight away, that is not a waiver of our right to enforce it later.
